Oakland shooting fuels anger over police brutality

OAKLAND, Calif. -- The videotaped killing of an unarmed black man by a transit police officer here has inflamed long-running tensions between police and many African-American residents.

Public outrage at the New Year's Day slaying of 22-year-old Oscar Grant intensified as grainy footage of the shooting played repeatedly on television and the Internet, while the officer remained free and not charged with any crime.

Dozens of black community leaders and residents berated Bay Area Rapid Transit officials for hours at a meeting Thursday, the morning after demonstrators torched cars, smashed store windows and threw bottles at officers in downtown Oakland.

More than 100 people were arrested and about 300 businesses were damaged Wednesday. Three of the people arrested during the violence were arraigned Friday on various charges, including vandalism, arson and firearm possession.

To many, Grant's death is the latest in a series of incidents _ from a deadly shootout with the Black Panthers in the 1960s to the fatal shooting of another armed man in July _ that have fueled mistrust of the police.

"Oakland, unfortunately, has had a history of treating the African-American community unfairly," said George Holland Sr., an attorney who heads the Oakland chapter of the National Association for the Advancement of Colored People. "The community has a great distrust for police officers because they feel they can't be punished."

Harry Williams, an Oakland minister, viewed Wednesday's violent street protest in the context of that perceived injustice.

"People are just fed up, and Oscar Grant is the match that lit up the dynamite," he said. Many residents perceive the police as "keepers of the gate instead of servants of the people," he added.

Grant was the first person killed by BART police since 2001 when a 42-year-old man was shot at a station in the nearby city of Hayward, said spokesman Jim Allison.

Despite criticisms from some black leaders, Oakland Police Department spokesman Jeff Thomason said the department reaches out to the community to work cooperatively to fight crime.

Thomason defended the 826-member agency's use of force, saying that fewer than one percent of contacts between officers and suspects result in shootings by police. There were 10 last year, including six fatalities, he said. No officers involved in shootings since 2004 were charged with crimes, and so far none have been fired.

"Officers are not going out there trying to gun down people," he said.

Grant, a supermarket butcher with a 4-year-old daughter, was one of several men detained by BART police responding to reports of fighting on a train full of passengers returning from New Year's Eve celebrations.

Amateur video by several onlookers shows Grant being pushed to the subway platform before an officer fired into his back, killing him.

Grant's family and community leaders have called for the prosecution of the officer, 27-year-old Johannes Mehserle. The Alameda County District Attorney's office is investigating, as are the Oakland Police Department and BART.

Mehserle resigned from the agency Wednesday but remains free pending the investigation.

Friction between law enforcement and Oakland's black community has persisted for decades. In 1968, Black Panther Bobby Hutton, 17, was killed by police during a shoot-out. More than 2,000 people attended his funeral.

Public confidence in the Oakland police was further undermined by a corruption case involving several officers known as the Riders who were accused in 2000 of planting evidence and assaulting drug suspects. The officers were fired but were eventually acquitted in two separate criminal trials. A judge ordered the department to implement reforms, and Oakland paid $11 million to 119 people who claimed they were abused.

Sociologist Benjamin Bowser of California State University, East Bay said a confluence of factors _ high unemployment, cutbacks in social services and a police force operating in a high-risk atmosphere _ contributed to the anger after Grant's slaying.

Before Grant was killed, many black residents already were outraged by the fatal police shooting of Mack "Jody" Woodfox, 27, after a car chase in July.

Authorities say Officer Hector Jimenez fired his weapon because he believed Woodfox, who is black, was reaching for a gun, but no gun was found. Jimenez is on administrative leave pending an internal investigation.

"There is a sense of frustration that the system is not responsive," said attorney John Burris, who is representing Woodfox's family and has filed a $25 million claim on behalf of Grant's family. "There is a sense among African-American youth that police accused of misconduct against them are not held accountable."

People are watching, there is no way you are in any danger, PEOPLE ARE WATCHING, and you kill not only an unarmed man but a demobilized man?

The media is trying to turn this into a racial issue and it isn't. This is about the police state and the militarization of the police force.

When the issue is framed by race, you have citizens fighting each other instead of fighting the cops and the government officials who set up this system.

Thank you for writing about this horrible shooting that, while not the only one like it by a long-shot, it is one of the rare ones that was caught on a video recorder which actually made it out to the public... most don't.

Also, thank you for linking to one of my articles on the shooting, hopefully it all helps bring about some change someday.

As to some of the readers who don't think this had anything to do with race... well, while I tend to keep people mindful that police misconduct and brutality are issues that affect us all and can happen to anyone of any color, so it's an issue we must all care about.

With that said, I'd be hard pressed to watch this video and come to any other conclusion than that if those were white kids lined up along that wall the police wouldn't have acted differently... I'm pretty certain you would have had a different outcome that night.

I heard about that, as I was in Houston this weekend. Very sad, had that man's father not been a high profile person (former pro baseball player), no one would have gave a damn and would the incident would have been dismissed as a "misunderstanding"

On a regular basis, this is being protested because of the fact it was videotaped and witnessed by several people, and would have been dismissed as an unruly ghetto youth who got what was coming to him.

Many more innocent cops are killed each year by black men than vice versa. This is another example of black people being myopic. How many time do these people march when an innocent cop is killed? According to the Bureau of Justice Statistics 2004 report (released May 2006), blacks commit 54 percent of the homicides in America even though they constitute only 12 percent of the population.

An individual black male is seven times more likely to commit murder than an individual white male. It so happens that black felons commit 43 percent of aggravated assaults, 66 percent of armed robberies, 27 percent of rapes and 85 percent of interracial crimes of violence, mainly against whites (this last figure from a Justice Department report 2003).

I saw this and wasn't suprised. All the cops in my hometown roll like that. It was a trip because the same guys that taught us DARE would look at us like criminals as soon as the program was over or we turned 13.

While I've always had interesting interactions with cops, mostly because I was WWB (walking while black), the BART variety was never around when I needed them most: when I was underage and being stalked by a much older and maybe slow man that didn't understand "NO."

It wasn't until last year that anyone knew what I was talking about. A guy in RPD came to our class to talk about his experiences in the department, which is surprisingly progressive considering the redneck-ery of the area.

He asked me why I was laughing about something he said and asked if I didn't believe him. I said I was from Oakland; he was a cop there and in Richmond. Oakland PD was why he left for another state. Pitts is a pretty friendly guy, but he made me nervous in his current uniform.

My teacher, a cop from Kansas with a PhD, couldn't understand why he made/makes me nervous until he realized what the police situation is where I am from.

What exactly do your comments about "black crime" and the "regularity" of such a thing have to do with a defenseless kid being shot in the back?

sAre you trying to say that he deserved it because he got stopped...and/or are you also saying that no one should care because people like him die every day and there are more where he came from?

We are reminded again of some of the risks of being a black and male in America. I have a friend with I huge fro and I keep telling him that he is a walking target.


I am going to be a devils advocate here( what's new) and suggest we look at things from a slightly different perspective.

Before this shooting, there was the story of the white guy that shot a black guy in a movie theatre because the black guy was talking through the movie. The Field Negro blogged about it and we were all in agreement regarding what a nuisance some of our cousins can be in public.

Anyway in that post I expressed my frustration with rowdy kids on the LA subways that prowl the blue and red line. I even said that I am waiting for someone to come and shoot one of those kids if this was the new MO. And Lo and Behold, this happened in Oakland.

Once on a train, one girl started shaking her ass in my face. Another time some stupid guy pulled my hair. I suspect he was trying to make fun of it. I hadn't been so angry in a long time. If I had a gun at that time, I would have shot his fingures if not him.
Now this is me, a regular rider, and I can't stand the nonsense of these kids. They behave like they have never seen civilized society. Now for a second, think of all those Cops or security people that ride with them all along. At one point one is bound to snap.
This particular cop probably had one last nerve left and it snapped. Its not a justification for killing someone but I think it could be a good explanation.
If me as a black person can not stand being around those rowdy subway stupids, imagine a white cop. I suspect if you put only black cops on these subways you would have the same if not more shootings of these kids.

So, there is more to this shooting than good old racism. We can blame the system that creates these at risk kids whose sole purpose seems to me to be, create disturbance, but we can not sorely blame the cops racism. There are many factors at play in this case.

I remember growing up, one of the worst things that could happen to you was being caught in some kind of public situation by someone else who then went and told your parents. Even just being noisy in public was enough to earn you punishment. Embarrasing the family in public is a big deal.
When I see this kids on the subway, they are not answerable to anyone. So they go out, create situations and then someone gets hurt in the process and it all ends in a riot. Something is not right. And its time to address all the problems not just the racism of cops.
That poor kid lost his life, and he won't be the last like we have seen lately.
With shootings like this , I think it is important we take a moment and hear the story of the other side. As hard as that may seem.

About the talkers in the movie theatres- 99% of the time when I go and someone is yammering through the whole damn movie, it's white people. I don't know why we're the only ones who got a reputation for doing that.

Anyway, is annoying behavior justification for killing people? In that case, let's have everyone carry a gun and be subject to getting killed or maimed if they forget their manners.

I think there is definitely a racial aspect to this killing. As was previously pointed out, had it been a group of white youths, this would not have happened. They probably would have been given a scolding and sent on their way, without guns being drawn.

From the video it does not look to me like this was an intentional shooting. I think the cop had his gun drawn when it didn't need to be and then he handled it carelessly. I went target practicing with my boyfriend for the first time last month and he repeatedly stressed to me the importance of always being aware of where you are pointing a gun and keeping your finger OFF the trigger until you are ready to fire. I kept forgetting and making him nervous I was going to shoot the table when I lowered my arm. I'm not expert, but I think this is what was at work in this case. He should still be held accountable and again, it probably wouldn't have happened had it been a young white man because the officer would have kept his gun holstered.

Lets not forget that I am talking about frequency here. If it was the odd incident, then a cop losing it is utterly unjustifyable. However if you are ever in LA try riding up the blue line and connect to the red line heading for Hollywood on Weekend nights. You have a 9 out of 10 chance of finding these nuisance kids.
If someone has to deal with them all the time, it can get to you.

I rarely go to theatres so that is not something I have observed. But many over at fields seem to agree with the premise.

Again its about frequency. How many white kids get rowdy on the same subway as opposed to black kids? There are too many factors at play here and we shouldn't ignore him.

I bet you if one tried to confront those rowdy kids on our Subway it could get ugly. If they were white kids (and I have never seen any like that) they could be alot more approacheable. So again its about frequency of the behavior potrayed in public by young black people that make the difference in treatment and ofcourse I am not ruling out the Cops racism. But if one is in public and creates attention to themselves in a manner of distraction, then they invite a series of things to happen to them. Worst of which is perpetuating the same stereotypes we loathe.

If more of these kids understood some public behavoior basics, they would not try so hard to attract trouble. And why don't these kids know these things? Its anyones guess.

Again the killing is not justifyable but I think we need to look all around for answers blaming racism alone has not stopped these incidents from occuring.

Because it seems, and not that I justify the actions of destroying property, but if you just say or show what is happening, people want to brush stuff under the rug. Johannes Mehserle, the cop who shot Oscar Grant, has just now been arrested. This was shooting was done in front of hundreds of witnesses and was videotaped from several angles. Now if that was a civilian of any race, in which that happened, would they be able to go around for two weeks walking around free. The man was practically vactioning in Lake Tahoe when he turned himself in, is that someone who seems concerned about what he did, and what everyone saw and videotaped?

What does this have to do with the price of tea in china? In terms of people marching when a cop dies. We recently had extensive media coverage over a cop getting shot in the line of duty in Dallas. He was white, he was shot by a black man. He was married to a black woman, who was also a cop. He obviously wasn't doing anything but doing his job when he died, and he received all types of vigils cops and citizens alike to pay respects to him. So people are vocal when a cop dies.

I get tired of that same old lame stereotype. Go to a white suburban theater, it is the same thing. Folks giggling loud, talking loud, and using cell phones, and they are all white folks doing this. I go to more "white" theaters than black ones, and find that black ones, at least if they are getting loud it is in reaction to the movie, and they shut up quickly, whereas at the white theater, they are just talking about something that has nothing to do with the movie. I walked out of a movie and complained a few months back because it was just so loud I couldn't hear the movie and after asking them to be quiet in a polite manner three times, I couldn't take it anymore, but I just left, I didn't shoot the folks in question, and if I had, my ass would have been sitting in jail.

Cops are supposed to exercise control over their emotions before going off and shooting people. They are trained and should be psychologically evaluated about that. No one should get shot for getting on your nerves. If you can't handle rowdy teens, you shouldn't be a cop.

So all annoying people must atone for other annoying people, and if you are in the wrong place at the wrong time, you should die? I don't think so. Cops are supposedly well trained in how to handle rowdy folks, but talking vulgar and shaking your ass is no reason to be killed.

How many of these rowdy white kids live in low income areas? How many white teens have cars vs. black teens? Why is it automatically assumed white teens or more civilized and less animalistic than black teens, because trust me, they are not.

If they were white kids (and I have never seen any like that) they could be alot more approacheable.

I call BS on that, my experience with white teens is that they are out of their damn minds, just like all teens. I know many aggressive, wild white teens, it is just when they are unruly they blame ADHD, or some other disorder, when it is black kids, they just think they are animals.

Also note in one of the videos posted, one of the cops, not the one who shot Oscar Grant, punched one of the people in the face. I didn't think that was standard procedure either. His name hasn't been released. So if they want to break, do that because apparently people don't care if a cop punches you in the face for no reason.

I used to get pulled over all the time for no reason. My rear light was dim and I was driving slow, so the cop driving alongside me for five miles just happened to notice my White BF at the time in the passenger seat. He asked me to blow into his hat because he thought that I was drinking and I wasn't, but since I was driving slow and had a dim tail light, I "looked suspicious." This ancient Redneck kept staring at my BF while talking to me. I found it hard to believe that his stop wasn't racially motivated. Or maybe I was just paranoid. I highly doubt it. The point is that there are some police who don't see minorities as human beings, even the ones who are minorities themselves because once they put on that uniform, they adopt the same "Us vs. Them"mentality. Not all cops are bad, I know a few who are great, but it's cops like this who give a bad reputation to others who are trying to live up to their "Protect and Serve" creed.

To answer yours: no, he wasn't too concerned about what was going to happen if he spent the past two weeks vacationing at Lake Tahoe.

And no, if you or I were caught doing what he did, we wouldn't be walking around town free as a bird to do whatever we wanted while this was being played out.

We would be stuck in jail, without bail, waiting for the wheels of justice to slowly grind to a halt.
